PURE OUTDOOR LTD – STANDARD TERMS AND CONDITIONS

 

1. FEES

1.1 All course fees include VAT unless otherwise stated.

1.2 All places must be reserved by booking online or by telephone and payment of the specified deposit or full balance.

1.3 The balance of the course fee is payable no later than 6 weeks prior to the commencement of the course. If the balance is not paid by this date, Pure Outdoor Ltd reserves the right to treat the booking as cancelled by the client and re-sell the course place.

1.4 For bookings made within 6 weeks of the commencement date, the full course fee is payable at the time of booking.

1.5 Gift vouchers are valid for 12 months from the date of purchase unless otherwise stated.

 

2. CANCELLATION BY CLIENT

2.1 All cancellations must be made in writing (email is acceptable).

2.2 In accordance with Regulation 28 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the statutory 14-day cooling-off period does not apply to leisure services provided on specific dates. As our courses take place on fixed dates, this exemption applies.

2.3 Cancellation charges are calculated based on the course commencement date (not any rescheduled date) and are as follows:

* More than 4 weeks before the course start date: 25% of the total course fee.

* Between 4 weeks and 2 weeks before the course start date: 75% of the total course fee.

* Within 2 weeks of the course start date: 100% of the total course fee.

2.4 Gift vouchers are non-refundable after the statutory cooling-off period (where applicable). Amendments and Transfers

2.5 Substitution of the original participant may be made provided:

* At least 2 weeks’ written notice is given;

* The replacement participant meets the course requirements;

* Pure Outdoor Ltd provides written consent. An administrative fee of £35 per substitution will apply. The original and replacement participant shall be jointly and severally liable for the course fee.

2.6 A client may request, in writing, to transfer to an alternative course or alternative date provided the request is made more than 6 weeks prior to the original course start date. The alternative course must be listed on our website or in the current brochure. An administrative fee of £35 will apply. Requests made within 6 weeks of the course start date will be treated as cancellations and subject to the cancellation terms above.

 

3. CANCELLATION BY PURE OUTDOOR LTD

3.1 Whilst every effort is made to ensure courses run as advertised, Pure Outdoor Ltd reserves the right to cancel or modify a course where reasonably necessary due to dangerous weather conditions, environmental hazards, instructor illness, insufficient participant numbers, or other circumstances beyond our reasonable control.

3.2 Where a course is cancelled due to insufficient participant numbers, clients will be notified not less than five days prior to the course start date wherever reasonably possible.

3.3 In the event of cancellation by Pure Outdoor Ltd, clients will be offered the choice of: * A full refund of all course fees paid; or * Transfer to an alternative course date (subject to availability).

3.4 Pure Outdoor Ltd shall not be liable for any travel, accommodation, loss of earnings, or other consequential losses incurred by clients in connection with a cancelled or modified course.

 

4. HEALTH, FITNESS, WEATHER AND EQUIPMENT

4.1 Courses involve physical activity, including walking over rough and sometimes steep terrain in varying weather conditions. Participants must ensure they are physically fit and capable of undertaking the activity booked.

4.2 Participants are responsible for ensuring they bring appropriate clothing and equipment as specified in pre-course information.

4.3 Outdoor activities carry inherent risks. By booking, clients acknowledge and accept these risks.

 

5. INSURANCE

5.1 Pure Outdoor Ltd holds Public Liability Insurance.

5.2 Clients are strongly advised to obtain appropriate personal insurance to cover cancellation, personal accident, and personal liability.

 

6. FORCE MAJEURE

6.1 Pure Outdoor Ltd shall not be liable for failure to perform its obligations where such failure results from events beyond its reasonable control, including but not limited to extreme weather, natural disasters, government restrictions, transport disruption, or other unforeseen circumstances.

 

7. LIMITATION OF LIABILITY

7.1 Nothing in these Terms and Conditions shall limit or exclude Pure Outdoor Ltd’s liability for:

* Death or personal injury caused by negligence;

* Fraud or fraudulent misrepresentation;

* Any other liability which cannot be excluded or limited under applicable law.

7.2 Subject to clause 7.1, Pure Outdoor Ltd’s total liability to any client, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall be limited to the total course fee paid by the client.

7.3 Pure Outdoor Ltd shall not be liable for:

* Loss of profit;

* Loss of business;

* Loss of opportunity;

* Loss of anticipated savings;

* Indirect or consequential loss of any kind.

7.4 Participants are responsible for their own personal belongings during the course. Pure Outdoor Ltd accepts no liability for loss of or damage to personal equipment or property.
